Effective Date: 13th August 2025

These Terms and Conditions ("Agreement") govern the services provided by Weir Photography, a registered photography business operating in Bundaberg, QLD, Australia (ABN: 80506219302), and any client ("Client") engaging our photography services. By booking a session with Weir Photography, the Client agrees to be bound by the following terms:

1. Bookings & Payments

1.1. Bookings can be made online or over the phone.
1.2. A non-refundable holding fee of $150 AUD is required to secure the session date and time. This amount will be applied toward the total session fee.
1.3. The remaining balance is due no later than 7 days prior to the scheduled session.
1.4. Accepted payment methods include credit card, debit card, and PayPal.

 

2. Cancellations & Rescheduling

2.1. Cancellations must be made no later than 7 days prior to the session. The holding fee is non-refundable under any circumstance.
2.2. Clients are allowed one (1) reschedule without forfeiting the holding fee, provided 7 days’ notice is given.
2.3. In the event of bad weather, Weir Photography will work with the Client to reschedule; however, we do not accept liability for weather-related cancellations or client dissatisfaction should the Client choose to proceed with the session.
2.4. If Weir Photography must cancel due to unforeseen circumstances, the Client will be offered a full refund or an alternative session date.

 

3. Session Details

3.1. Portrait sessions may take place in-studio or on location as agreed upon at the time of booking.
3.2. Sessions typically last between 1–2 hours, depending on the type and scope of the shoot.
3.3. Images are delivered via online gallery, where clients may select their preferred images.
3.4. Prints and products are available for separate purchase after image selection.
3.5. Final image delivery will occur within 2 to 8 weeks, depending on workload and order specifics.

 

4. Image Use & Copyright

4.1. All images remain the copyright of Weir Photography.
4.2. Clients are granted a personal-use license only. Images may not be used for commercial purposes without express written permission.
4.3. Weir Photography retains the right to use images for portfolio, website, and social media marketing unless:

• The session includes boudoir images, or

• The Client explicitly requests otherwise in writing.
  4.4. Clients may request that specific images not be published, and reasonable efforts will be made to honour such requests.

 

5. Liability & Conduct

5.1. Weir Photography holds appropriate business and public liability insurance.
5.2. Clients are responsible for their own conduct and safety during sessions. Weir Photography accepts no liability for personal injuries, damages, or losses that occur during the session.
5.3. Late arrivals will result in a shortened session time.
5.4. In the event of inappropriate or disruptive behaviour, the photographer reserves the right to cancel the session immediately without refund.

 

6. Website & Privacy

6.1. By visiting our website www.weirphotography.com.au, users agree to use it for lawful purposes only.
6.2. Weir Photography collects email addresses through its website for marketing purposes. Users may opt out at any time via unsubscribe links or by contacting us.
6.3. Digital information packets may be provided via email upon request or subscription.

7. Amendments

Weir Photography reserves the right to update these Terms and Conditions at any time. Changes will be posted on the website and will take effect immediately.

By booking a session with Weir Photography, the Client confirms they have read, understood, and agreed to these Terms and Conditions.
